It means that if you choose to not adhere to a default standard, you must inform anyone you put at risk because of the choice. An example is the label "experimental aircraft" on amateur-built (non-certified) aircraft. Another example would be a medical services contract where the contract would have to spell out any liability conditions that are not part of the default medical liability formula. If you want to build a house that doesn't meet the (now voluntary) building code, you would have to inform any purchaser of the deviations from the code.

The idea is that a person should be safe to assume that certain standards are met unless told otherwise. Informed consent should override the nanny state's desire to protect us from ourselves.
