Yes. To hold someone for months on a simple immigration charge is simply contrary to our Constitution. Think back in history, and in today's totalitarian regimes, where people were held indefinitely without being charged, or arrested on minor charges and then being held indefinitely.

If we revoke simple civil freedoms that we have held dear for more than 200 years, then the bin Laden's win.
