Uh, if you paid any attention to this discussion, in this case, I and many others were clients of, and executed formal agreements with, the defendants. The law makes very clear therefore that the defendants are indeed fiduciaries.

You are still a "victim", aren't you? You were unable to evaluate all available information and make an independent investment decision, yes? Therefore, the article clearly has relevance in your specific case.
