Oops, what does this say?

web.archive.org

"BigEasy Investor is on the cutting edge when it comes to providing buying opportunities," said CyBerCorp CEO Philip R. Berber. "Paired with CyBerX Plus, investors will now have access to a complete trading solution. This partnership is further evidence that CyBerCorp is becoming one of the industry's leading providers of electronic trading technology."

"The integration of CyBerX in to our product means our users will now be able to immediately act on information they find within BigEasy," said Chad Clifford, the CEO of Ten Bagger, Inc. "It's very much a needed solution and a great match."

There's Berber himself saying "buying opportunities." That's a clear recommendation. But there is a bit more here:

The integration of CyBerX in to our product means our users will now be able to immediately act on information they find within BigEasy.

Uh oh, not very good news for the no-direct-connection-between-kickbacks-and-advise-to-client-executions argument. Like I said, I did my homework.

Message to CyberTrader: now I wouldn't go deleting that record if I were you, if you care about keeping your brokerage license.

STOCK PICKS SERVICE

I hope Rea doesn't try to argue again that he never gave investment advice, because his kickback partner CyberTrader on its own website says he did. Oops!

stock picking and investment advice are completely different things. The fact that you consider stock picks to be investment advice does not mean that you will be able to convince a jury of the same thing. Remember, they are going to have lawyers there that are going to be able to explain the difference in layman's terms.
