What right do you have to use the machinery of the state against someone who wants to marry a person of the same sex?

Who was talking about using the machinery of the state against anyone. If the state doesn't sanction it then the people involved are not legally married but no action is taken against gay couples who live together and consider their relationship to be equivalent to a marriage.
