True, but it is if the state is party to excluding you due to group identification.

I actually agree with you, though I believe that your analogy doesn't really work with regard to state actions.
I get very irate when private individuals can be told who they have to hire or rent to; I believe we should be able to do privately as we wish. However, if you choose to do this based on anything other than qualifications, it IS a personal prejudice.
If it is a widespread one, the result is, no matter how passively carried out, damaging to a class of people. And if it agreed upon by many, then I suppose you could use the word "conspiracy".

But the government should not perpetuate laws that are based on personal prejudice. There has to be more valid reasons for their exclusions. that is all I am saying.
