You cannot leave the issue of individual rights in the hands of the majority I guess therein arises a further (or a repeat) problem.

Indivuals can modify any law by challenge through the court system

The supreme court itself can be manipulated by the inclusion of judges with a certain type of history <<predisposition>> thereby hedging the bets of those that desire certain outcomes irrespective of the population. Now we come to the point that selection of said judges determines much of our lives and the direction of the country. Maybe we should get to vote for them too ?
