You're right that it probably won't get caught for quite a while. But the likelihood is that eventually it will crop up somewhere. Title companies tend to be fairly careful about who they issue titles to, and if they want to get divorced it's going to pop up. And if they both show up as parents of kids in school, questions are going to come up.

And with Canada now marrying same sex couples (and it will only take one more court case before polygamy is legal there, too), I suspect that there are going to be more checks than there were in the past.

Social Security, too, will be an issue, because under federal law they're not married for federal tax and social security purposes even if they're married under Canadian or some state law. And they may have to lie at various points along the way about gender.

Actually, a number of couples do act as though they were married even if they actually never were, and get away with it for some time. But it's dangerous, becasue usually the family knows (especially if it's a same sex couple), and just wait until one dies and the will gets challenged. Then the fat will hit the fire and somebody's likely to lose their inheritance.

Of course the same argument can be made if somebody "marries" a minor. Are you saying that there should be no consequences for that, either?
