I agree, but I don't see how you apply that to the Judge Moore case. Do you think that the opponents of the monument are litening actively to Judge Moore and trying to see his POV? Do you think the ACLU thinks it is hyperventilating and making an honest effort to quit it? Do you think they're trying to find some change that will meet both sets of legitimate interest?

I haven't followed the case closely enough to know what negotiations, discussions, etc. they engaged in before filling suit. But I have seen nothing that suggests to me that they accept that Moore has a legitimate POV. Nor, I will agree, the opposite from him.

We were talking not about a general issue but about a specific situation. How would you apply your principles to that situation?
