I agree. Unless he beats her or makes a clear threat of violence, there is a distinction to be made between real and "date" rape, and there is some burden on the girl if she placed herself in a situation to cause confusion, or behaved in a way that poured gasoline on the flame.......

Yes, but you're talking about an informal resolution. I agree there is blame on both sides, and informally, that can be dealt with as you suggest or as I suggested or some other way. When it hits the courts, though, the cookie cutter is applied and informality and gray dithering are out the window. That's why I suggest the grey ones not reach the police. All this talk about shared responsibility in a criminal matter make it harder to prosecute the black and white rapes. And we have to defend that capability.
