Ah...I am amazed that I didn't notice before how "black and white" relativists (not you necessarily) can get on some pet issues. I need to pay closer attention to that.

Many cases are pushed in the criminal courts because one of the disputants is looking for a pound of flesh. I would like to see something like a requirement to sit down in mediation prior to elevating cases to trial. Often times the prosecutors become more victim's champion than representative of the state. This should be a two phase approach, with the first phase being education and the second phase being an attempt to settlement. When the disputants are faced with the level of litigation that can be charged and counter charged and the risks involved, the likelyhood of going through full blown trial would be mitigated.

In civil court this should be a requirement in all cases.
