It would only happen if a potential black client approached them and was told no and and either was told it was because they were black, or were given some fake excuse that didn't make sense outside of race, or more likely that several potential black clients approached them and were told no while similarly situated white clients were told yes. There would have to be some aggrieved party with at least a reasonable basis for thinking they were being discriminated against on account of race or gender.

I am also reluctant to add unnecessary laws, but I think this principle -- that as a society we don't accept racial or gender based discrimination in the public or business arenas -- is important.
