The questions are:

1) Does North Korea have nuclear weapons? Remember, they have not been tested yet.

2) Under what circumstances would North Korea use their nuclear weapons?

Re 1) I expect that North Korea will test a weapon as soon as possible. It makes their threat credible. I wouldn't be surprised if North Korea invited the US to watch the test. I think that the public might be told of such an invitation by North Korea. It would be a slap in the face to the US so if Intelligence says that a test is about to happen the US would be faced with a dilemma, announce it first or wait and see if it happens or preempt NK by attacking. Some very hard choices.

Re 2) If North Korea is attacked it will use it's WMDs. North Korea saw what happened to Iraq. Iraq was disarmed and got attacked.
