Looking for, not charged, or convicted?
Yes. He murdered him, and their will be little or no empathy from the public, since he was targeting inocents. Seems like its an easier one to get a conviction on than the terrorist.
And you can definitely charge attempted murder for the one's he missed.

Your case is, I think, different because the victim was not in the process of committing a crime, and because the guy presumably climbed the water tower with the intent to shoot people, so it was part of a plan he was carrying out. Both things make it different. Your guy, yes, gets tried for either murder or manslaughter, probably murder.
