There is a default assumption that people will be treated equally in decent society

I'm not entirely sure what you mean by that. If you mean things are normally better and more decent when people are not discriminated against based on things like race, or religion, or sex without good reason to do so then I agree, but I suspect you might mean more then just that.

Outside of the law..you do not tell the rest of us what harm is or is not.

No I am and should be free to say what I see as harm and what I don't see as harm. Also it is a quite logical position to say that someone who has not done anything to you has not done harm to you.

My point was not a legal one.

Neither was mine.

I never said that being a jerk was illegal.

Neither did I, nor did I assert that you said that being a jerk was illegal.

I only said that being a jerk can be harmful.

Certainly the actions of a jerk can be harmful.

I believe that people have the right to be ass-holes, jerks, and freaks.

I would agree.

My point was only that idiots can cause harm--just as good people can cause happiness.

I agree with both ideas, idiots can cause harm, and good people can cause happiness (and the reverse is also true even if it happens less often) but I don't think that was your only point. It may have been your overall general point but you applied it in specific ways to specific hypothetical situations and said that some of the people in those situations where causing harm.
