DO NOT MAKE THE MISTAKE OF ACCEPTING WHAT YOUR BROKER SAYS IS A STANDARD CONTRACT IN THE LISTING OR SALE AND PURCHASE OF YOUR HOME. It's Plain and Simple non-sense!

Did you know that there are more than 45 states in the U.S. that have laws requiring attorneys to be used in all buy, sell or trades involving real estate?

Why are attorneys not required in California? That is a good question! The answer is simple - Politics!

The real estate agents, brokers and escrow companies have a strong lobby in the California Legislature that makes sure California does not have such a requirement.

I'm sure you have heard brokers and/or agents say, "Lawyers just delay or foul up any deal". What they really mean is that I do not want anything delaying my commissions no matter who it hurts....leaving you unprotected!

An old friend of mine in Texas sold his place with a sales contract he bought at Office Depot! He was financing the sale himself, and recently repossessed due to non-payment, after trying to work with the buyer for a while. No Agents, no lawyers..and no problems. This may have been luck, but it worked in his case.
