rruff, thanks for the kind words. I am no lawyer, so I cannot give you any cogent analysis on the potential outcome of future litigations. As a strategist, the fact that the opposition to the bu$$ chose the route of the FTC (I believe because there exists some incestuous relationship with the MU legal team) as the main line of defense, and this line seems to be crumbling, at least a little, and furthermore, some of Payne's decisions (particularly narrowing the scope of "Bus" in the claim, which seems to have been questioned elsewhere), indicates to me that if the FTC follows their Unocal decision here, the battle ground may shift to negotiations rather than litigation. Of course, Appelton is a fighter and may not give up easily, so volatility will be the "name of the game" for a little longer.
