There is no protection, the guaranteed existence is an unattainable myth. But you wouldn't want it because nothing kills you faster than the absence of competition. What has enabled the US to go on and create the next thing over and over is the fact that human capital is constantly freed up. If you are spending ten hours a day plowing your field it's pretty hard to invent the next thing. Same way if you are spending ten hours a day making sneakers it's difficult to spend time developing nanotech or develop a new way of automating assays to test new drug efficacy.
