Burning crosses, per se, isn't illegal. You can burn crosses on your own property, if you've a mind to, and the KKK can burn crosses in political ceremonies in the public square. It's the intent to intimidate that is illegal.

Not unless you are engaged in vandalism with intent to intimidate. In any case, the burning of a cross is not considered a religious expression, but a political expression.
