Though bin Ladin wasn't captured at Tora Bora, I am not wrong is saying that if he had been, your interpretation of the GC would require us to refrain from interrogating him. The war has ended in both places, so if Bin Ladin is captured in the future, it will not be on a battleground while fighting a war. Wait a minute. The occupation of Afghanistan is ongoing and occassional fighting occurs. If he were to be found now and his security forces fought US forces, there would presumably be a battle. Your post says that the war has ended in Iraq. I wonder if that means you think we were wrong in designating Saddam Hussein as a POW?
