That Levine patent certainly seems to cover the invention. Which is why GMST may not have needed any cross-licensing from TiVo. Also, thinking about it, a cross-license to TiVo is a cross-license to possibly everyone else and that would be healthy to the TiVo business.

The way the TiVo settlement was structured seems to take into account that TiVo simply does not have that much money to pay out at present, and if GMST were to demand it anyway, they would lose an industry pioneer and another potential distribution channel.
