He didn't say that. He said he'd have to address the conflict of interest. So what he did was keep his options with the agreement that he'd donate any profit from them to charity. Furthermore he's pledged to not even take the tax deduction from the charitable donation.

His severance package come in the form of an annuity payment. The total package was 36 million dollars and is paid out over time in staggered amounts. The amounts from this have NO relationship to the stock price.
