Why don't you email the author of that article and ask him? I can tell he has no idea and couldnt find his e-address. If what you assert here is accurate, then it's certainly a negative issue for the open source concept. May seem that way. But refusing to do that is the reason more vendors publish their specs, as Linux gets more users. Las Vegas could also be said to show the worst aspects of the capitalism that has made your country so great.
