There's a big, a very big difference in "cannot perfectly live up to the higher standard" and the creating of a lawless system bypassing Geneva conventions (Guantanamo) or establishing a widespread and well thought torture system aiming delibarately and precisely at the most vulnerable point of the human beings living in the invaded and occupied country: nudity, sexual abuse, sexual degrading and humiliation.
