"as an investor in RE it is best NOT to have a broker license (or any license whatsoever) as it opens the liability door a little wider, since you would be deemed to be an "expert"....

If I understand your statement correctly, you have more flexibility as an investor and the dumb flag will wave...

it could be shown that this activity is a means for your livlihood and claiming ignorance would be thrown out the door. In fact, it can be shown that you are an expert it in this field, and that the degree of liability would be equal or greater than that of an agent. Even for passive investing, be careful about the claim of ignorance.
