I would look at net effects in determining (anti)discrimination policy. The "Ladies Night" case is not an issue of true discrimination, but instead a fallacy by imagination.

That's a good method for determining what you want in the situation. You seem to want the best result for the most people. But how are you going to get there. I'm thinking of the regulatory, judicial, or political process for implementing the decision or the process for overruling bad decisions more then I am thinking about the process you would use to make your own decision. Once you reach your decision how are you going to make it happen?
