Again, the Bush folks never did win the statutory contruction argument. Had the case only been about that, they would have lost. They won on the ground that the way the law was being implemented violated the US Equal Protection Clause. So the state statute allowed Gore (and Bush) to pick and choose, but the Supreme Court ultimately concluded that manner of enforcing that statute violated the federal constitution becuase there was no law, regulation or other authority for ensuring that all manually counted ballots were counted in a consistent manner.

Listen, ultimately the US Supreme Court ruled in favor of Bush. My only point is that when Gore filed with the counties for a manual recount, he was authorized to do so by state statute. Good night.
