I do follow Vical a bit,and my Mom owns a bit (significantly under water on that), and indeed, Vical deals with plasmid constructs of naked DNA:

and presumably has some IP in this area. If Mirus used those constructs, they might have to talk to Vical. But note the Mirus method involves something I don't think Vical would have envisioned: using a tourniquet to raise intravascular pressure. So I would guess the two won't be squabbling over this, but I'm not exactly a guru on the subject.
