JF, The same thing could be said for criminal trials, very complicated issue with DNA test, etc. Are you saying that the the jury system isn't up to the task, in either case? That we shouldn't try criminals? Are we to throw out the trial by a jury of your peers part of the constitution?

It seems in this case, the jury system wasn't up to the task:

cnn.com

Three teenage punks drug a girl and rape her repeatedly, and it's all caught on tape. The defense, of course, argued that the victim was a slut, wasn't really unconcious, and was an aspiring porn star who was play-acting throughout the ordeal. Even got an "expert" witness to testify to that.

Don't get me wrong, I'm not sure we should throw out "trial by jury." But sometimes stuff like this really gets my blood boiling. By the way, one of the defendants is the son of the assistant sheriff of Orange County, and he's also got quite a criminal record, too.

John,

That's why we have lawyers on both sides. The same thing could be said for criminal trials, very complicated issue with DNA test, etc. Are you saying that the the jury system isn't up to the task, in either case? I am not not completely sold on the jury system. It is just one of many different systems in the countries with democratic countries with rule of law. It is an admirable concept, the application of it to certain cases may be questionable. Medical malpractice cases are a good example, IMO, where it doesn't fit very well.

And people call Michael Moore a wild eyed fanatic. You are way off the scale. Get a grip man.

Are you disputing that the contributions from trial lawyers were disproportionate? Or that he won his senate seat largely thanks to the fortune he accumulated ripping off the the system as a trial lawyer?

Joe

I think Joe posted earlier that he was against the jury deciding how much to award but not necessarily against the jury deciding if the person sued was responsible.
