Tim, That is somewhat true and unfortunate but if you totally disallow the "throwing mud" then you weaken legitimate defenses.

Yes, yes, I already realize the consequences of drastic solutions, such as disallowing "legitimate defenses" or getting rid of the jury system. But in the end, it's still a system, and the system can be worked and manipulated by the unscrupulous.
