If he did nothing more then wear the mask in the store it would be the trigger happy store owner who bears the responsibility for putting the others in the store at risk.

and i find it somehow difficult to imagine that i would take to kindly to some asshole walking into my place with his face covered with a ski mask...

You said a misdemeanor wasn't enough. That would apparently mean that he should be charged with a felony which could entail penalties much greater then a year in jail.

Also to my knowledge there was no specific law against wearing a ski mask or concealing your identity in a store or in a place of business. The charge of "Making a terrorist threat" would be silly if he didn't actually face penalties for it. He made no such threat. What would you charge him with that would send him away for a year or more?

Edit - Apparently in this case he only faces up to a year.
