I can walk into any court in the land and find two "educated" lawyers taking opposite positions on questions of both fact and law.

Far less than 20% of cases filed ever get to that stage, and even less of potential cases. So if you get to the point that the lawyers are butting heads, you've got at least colorable contested issues.

The winnowing process is constantly separating the wheat from the chaff.

The same thing goes -- if you don't have a case, close up your briefcase and go home.

Similarly, I read today that good chess players concede defeat when it's inevitable rather than play the game to the bitter end, but then, good chess players can see enough moves in advance to realize when they've lost.
