The indirect costs associated with the threat of malpractice law suits is significantly higher than 1%.

Intuitively, I had always assumed so, too. However, I have always had a lot of respect for CBO and I can't just discount what they say.

Even if the costs are "only" .4 percent, that doesn't mean that they shouldn't be mitigated. That's still a lot of money. .4 percent here and .4 percent there, well, it all adds up.

Annual spending on health care by all sectors is $1.2 trillion, about 14% of GDP. Reducing that by 1% might seem like a small amount, but it's still $12 billion.
