You evidently don't understand the meaning of the word "depends", or you have poor grammatical skills. Go back to high school and practice subject predicate....

what was discussed, and did Kerry know he still was in the navy, subject to its rules and regulations.

As long as Kerry didn't promote anti-American activities during this meeting, it doesn't matter to me whether he knew he was in the Navy or not when I determine if meeting the Viet Cong government reps was treason.

Kerry didn't release his notes on the meetings, and I have no idea how clearly the navy briefs their personal, upon discharge from active duty, what their obligations are for their period of inactive duty.

Yeah, so? To state that his meetings were treasonous without any knowledge of what was discussed at the meetings is.....in my opinion.....stupid.

The fact that the navy didn't prosecute Kerry, doesn't necessarily mean they were, or weren't traitorous, as political considerations probably were more paramount.

Well I can take the US government's view, or your view, and I'll choose the US government's. He wasnt even charged, so this discussion is a waste of our time.
