Do you see that both examples involve the government?


Both involve the government but one is a restriction on your freedom and the other really is not.

Creative destruction means breaking down institutions and replacing them with something new.

No it does not have to be something new. In its traditional use (in economics) a new item or procedure might become popular, and than it might be swept aside in favor of a replacement in short order. Or the new item or service or procedure might be introduced and never even get the chance to be popular because it doesn't meet the requirements of the market, and the businesses pushing it might be destroyed or at least have losses because of this mistake.

Sort of like discrimination. You can't use that term to apply to the exclusion of majorities

Majorities can face discrimination. Not only in cases like South Africa where the minority had the power, but even in more normal cases where the majority of power is with the majority of the people. If you have two applicants for a job and they have the same skills or the majority candidate even has slightly better skills and qualifications but the minority candidate gets the job because of affirmative action then the majority candidate was descriminated against.

If you want to call the part of the gay marriage issue that deals with judicial fiat the creative destruction of the judicial system, I won't give you an argument. <g>

The creative destruction of a certain ruling, or even a certain line of legal thought but not of the whole judicial system.

I think a process like "creative destruction" occurs with social change but social change is important in a number of ways from market place driven changes. While your recognition of the similarities is an interesting incite I'm not sure I would use the same name. If I do use the same name as a nod to the similarities I would still think that recognizing the difference is important. To the extent that there is a shared culture it is not simply the actions of individuals in a free market. Tradition place a much more important role in culture, and a somewhat more important role in law, than it does in the free market.
