Hard to say what he did... since they won't release any of the memos (and refuse to claim executive privilege either... they cite 'tradition' for not letting Congress see the memos.)

As far as this: "Also, every one of those scholars agreed that the Geneva Conventions DO NOT apply to terrorists as they are STATELESS" I'd have to say that those purported 'scholars' on FOX sound like they haven't bothered to actually READ the Geneva Conventions.

The Conventions clearly state that EVERY prisoner is assumed to be covered by the Geneva rules... UNTIL there has been a judicial proceeding that rules otherwise in the individual case.

(In WW II it was considered acceptable to have quick military tribunals in the field to rule whether or not the individual was to be accorded the protections of the Geneva treaties.)

You miss the big point ie torture can be justified in some circumstances. That makes us bad guys. The bigger problem is that he believes the president doesn't have to 0bey a law he thinks is unconstitutional. Its the job of the judiciary to make such decisions not the executive branch and thus strikes right at the heart of our democracy by ignoring the checks and balances built in to our system of government. That added to his embrace of killing and torture makes him totally unfit for government service. Its sick to argue when torture might be legal or when arrest and confinement without due process might be legal shows just how debased the Bush team has become. This is the realization of the worst fears of the bush haters and I am shocked that so many as yourself don't see the implications of what is at stake.
