You are still missing my point. I'm not calling them POWs. I'm saying that if the HIGHEST classification they COULD get, aka POW, they can't challenge their detention. That means that all the lower classes such as illegal combatant, combatant, partisan...certainly cannot challenge their detentions either. Are you saying illegal combatants and partisans get more rights than POWs? If so, then whats the purpose of the Geneva Convention at all if those covered by the Convention are entitled to fewer rights than other combatants?
