"That means that all the lower classes such as illegal combatant, combatant, partisan...certainly cannot challenge their detentions either." WRONG! The Geneva Protocols REQUIRE every insurgent who is detained to be afforded the protections of the treaty UNTIL & UNLESS they have been adjudicated and legally determined to NOT be POWs. (Although, the adjudication process need not be up to 'civilian standards'.)
