So, the order states that this power to turn people over to "the control of the Secretary of Defense" ONLY extends to non-US citizens (so the detention of the US citizen we had arrested and tortured in Saudi Arabia would appear to be in violation of this executive order....)

Secondly, the assertion of an unlimited and untrammeled Presidential authority to single-handedly classify people as 'non-combatant detainees' would appear to be in violation of the Geneva Protocols' (signed by a previous US President, and RATIFIED by CONGRESS) requirement that such classifications of people captured on foreign battlefield, but not in military uniform, MUST be accomplished by a competant tribunal with jurisdiction, (not by executive fiat)....
