If there are no courts you can do whatever you want, and can get away with. No courts, no police = no "law". The "right" of self defense is a right created by law so that in the obvious situation when you are about to be killed you need not fear prosecution if you defend yourself. I don't see how you could possibly analogize it to a situation where there is ambiguity, because ambiguity can throw you in prison if you are trying to use self defense.
