As we're trying to have a rational discussion here and I commend your post otherwise, could you explain this part

that said i also saw the prosecution's aggressive tactics over the top. but hey, that's life. look at some of the hi profile murder cases, i guess it's nothing new.

my lesson learned here, don't expect things to be fair.



From what I've read, I don't think the prosecution's tactics were aggressive at all. Everything was discussed well in advance. There was no surprise bombshell. The judge was notified in advance. He had time to make rulings, admonish the jury, take them out of hearing, etc. One of the damaging references relative to past criminal activity was apparently made by defendant's own counsel in questioning the parole officer. This trial was actually fairly tame for a high profile case.

As for "fair," what do you mean by that?

Is it "fair" that those who extort, use misappropriated information for trading and then trade against their recommendations are called for that activity?

If the fact pattern were a tout doing all this, I would imagine that there would be a myriad of posts all over the message board attacking and urging prompt and severe action.

Peter M's post about his experiences at the trial indicated that Breen was professional and fair, not overly aggressive.

I know it's human nature but people tend to demonize and make stuff up. There was even another poster who claimed that Breen and his associates were unprepared and don't know the securities business. How obviously far from the truth was that.
