How can a trial yield that? Seems like two different tracks, no?


Its one of the ways that new laws are created. During the course of the trial, the GOP will submit testimony that may show that current election laws do not cover all the problems emanating from a close election. The judge may then rule that current state laws are inadequate and need to be revised. Remember, there has never been a statewide election this close in WA history. The judge may decide that state laws put into place to handle such an eventuality did not work as well as expected and they need to be revised.

Remember....courts not only interpret the law but they lay the groundwork for new law to be created. Think in terms of Roe vs Wade.
