Sad, very sad. Seems to me the judges insist on rehashing the old claims rather then allowing a new "de novo" suit to be prepared as the law required. jdn

In such a suit, the District Court shall determine de novo any claim of a violation of any right of Theresa Marie Schiavo within the scope of this Act, notwithstanding any prior State court determination and regardless of whether such a claim has previously been raised, considered, or decided in State court proceedings.

I feel so very sorry for Terri, her parents and her siblings. This has got to be not only AWFUL but totally not understandable. jdn

So these judges deny justice for what? To make a point of law?

What a mockery...when the law becomes ridiculous there is no law...
