If you read what I've written on this issue, you'll know that I didn't see any need for the federal courts to be authorized to hear the case in any way, shape or form in the first place. Once the law was passed, however, my opinion was that until it was declared unconstitutional, the Schindler family had every right to pursue whatever remedies the law granted. I think the Schindler's lawyers who pursued the federal case did so atrociously. The law required a more thorough review of the facts. I don't see that they properly asked for it or, if they did, that they vigorously attacked the cursory way in which the review took place. Judges generally only deal with what is before them. If you don't ask, they will consider that you have decided not to do so for reasons of your own. I think that is the gist of what happened. Going after judges who are simply doing their job is ridiculous. The Schindlers should ask their lawyers the questions I've suggested. Having seen what appears to have been bad lawyering on the Schindler's lawyers part which I think is inexcusable, I still think it would have been impossible at the end of the day to reverse the decisions of the Florida state courts. The review was extensive and thorough; anyone who thinks otherwise and who imagines some sort of nefarious conspiracy took place needs to have their head examined. There are a lot of extremely crafty and manipulative pols, like Santorum and Jeb Bush, who are improperly taking political advantage of a family's plight. This is the real tragedy of the situation.
