Volokh's point about the presence/absence of some formal body which calls itself the "Constitution in Exile Movement" is interesting. But, so far as I am concerned, the point is not the movement; rather the desire to return to prior 1937 legal thought and the number of folk in the Bush pool or near-pool who share that belief.

Now had he argued that this body of thought does not favor overturning environmental laws, minimum wage laws, etc., then he would have had a point. I gather, however, he concedes that point.
