Pete,
What "court"? A governmental agency decided they believed some of Intel's business practices violated the rules... they offered a solution to Intel. Intel stated they believe the practices were within the law, but did not feel the fight was worth it. It's a cost benefit issue... spend millions to defend yourself when the deck is probably stacked against a US company in Japan, or agree to not offer deeper discounts and or design support for market share (which some have said were offers the Japanese companies made to Intel). Intel obviously believes they will not lose more profit then an estimated fight would cost.

Intel's financials continue to get better (another couple of billion in the "bank") while AMD can't seem to generate a profit that will enable them to compete.
