What I don't get is just what is an activist judge? I thought when cases came to the courts it was because the constitution and laws were not entirely clear when applied to certain situations. In such cases any ruling is activist and liked or disliked depending on where one is coming from. Scalia was an activist in the 200 election when he basically said he would bend the law this one time but don't use the case as aprecedent. If people don't like the way judges rule they should change the laws or ament the constitution, not complain that laws were INTERPRETED incorrectly.
