Of course. And that's fine. A "up or down vote" on Judges is the right thing to do.

There have always been filibusters.

In the 225 years of the Senate there have not been filibusters of judges that would have passed with a majority vote. Daschle changed this with his attempt at obstruction at the cost of all norms. If it goes back to this and the republicans lose control of the senate then they would just be going back to the norm that minority parties lived with for the last 225 years. The one filibuster you are thinking of is Abe Fortis but he would not have passed with a majority vote.
