Exactly my point Mike.. If judges are held up, it is incumbant on majority party to make their case efffectively to the public and let the voters deter these folks from doing this again. It doesnt mean that you alter rules that have been in place forever to attain your goal. The US senate isnt a corporate boardroom Mike. It is essentially an undemocratic body that is there to control a hot majority. Whats going on is less about Appellate judges and more about the SCOTUS choice(s) that are coming. In the present environment sans filibuster even Robert Bork would go through and that to many folks would be a disaster. (I will not participate in a Bork debate. I am just making a point.)
That would be like if the dems had control of congress and presidency and the President nominated the liberal equivalent of Bork. I cant think of a name but perhaps you can. If you can you will see that in such a case, you would yearn for the filibuster Mike.
Having said all of this, the rules change does not present a constitutioanal issue imo, it is just bad policy if you view events with a time frame longer than a couple of years. You know this though mike but you may be blinded by your view that republicans will be in power forever and dems never could win control of the senate and presidency again. Mike
