I don't think it's about jumping over so much as looking at it concurrently at more than one level.

Once you conclude that she had due process, however, revisiting what she wanted is moot and the issue becomes solely one of the impact on the right to die at the hands of those who oppose the right to die.

(Yes, I recognize the difference between due process and the correct determination.)
